APPEAL COURT REINSTATES OKORIE AS EBONYI PDP CHAIRMAN

The Court of Appeal sitting in Abuja this Monday, 23/5/22, has ordered the reinstatement of Mr. TooChukwu Okorie as Ebonyi State PDP chairman with effect from April 13, 2022.

The ordered as part of the appellate court ruling in a motion for stay of execution of the judgment of the Federal High Court, Abuja which had nullified the election of Mr. Okorie as Ebonyi State right chairman.

The Appeal Court judgment rightly stated that the order of the appellate Court takes effect from April 13, 2022, when the Notice of Appeal and motion for stay of proceedings was filed in court.

The Appeal Court, in ruling on a motion on Notice for a stay of execution filed by the PDP and Mr. Tochukwu Okorie frowned at the conduct of Onu who was quick to assume the chairmanship of the state even when he was fully aware of the pendency of a motion for stay of execution of the judgment of the lower court.

Lawyers for Peoples Democratic Party, commenting on the decision stated that the judgment implied that all actions taken by Silas Onu since 13/4/2022 remain null and void. This is because the court judgment directed all parties to maintain the status quo that existed before the delivery of the lower court’s ruling on same April 13.

The judgment however maintained that the ruling stands, pending the hearing and final determination of the appeal by the appellants which is still pending before the Court of Appeal, against the judgment of His Lordship, Hon Justice A.R. Mohammed of the Federal High Court Abuja Division, delivered on the 13th day of April 2022.
